Back | When (1) a person's "vested" liberty or property interests are (2) affected by govt or "state action," person is entitled to Procedural Due Process (PDP), (3) including notice (reasonably designed to get you notice) and meaningful opportunity to be heard. EX: PDP? YES, terminated civil servant or tenured faculty member at LSU; NO, at-will employee How much process is due? Factors: (1) common law safeguards enough or need extra? (2) pre-deprivation hearing needed? (3) will extra procedures substantially reduce risk of deprivation? (4) historical incidence of abuse?
