Text | Introductory statement if essay asks about California evidence Civil: This case is civil so Prop. 8 will not be applied to the evidence. Criminal: Under Prop. 8 of the Cal. constitution, any relevant evidence may be admitted in a criminal case. However, Prop 8 makes an exception under CEC 352 and gives the court discretion to exclude relevant evidence if its probative value is substantially outweighed by a risk of unfair prejudice, confusion of issues, or misleading the jury. |
